Why you should register your lease ...and anything else relating to it

Discussion on the necessity of registering leased lands

AustraliaReal Estate and Construction

For over ten years a tenant happily occupied some retail space in a shopping centre in Queensland. Their nice landlord had allowed them to occupy additional space in front of their premises for the whole time, rent free. However, the landlord sold the shopping centre to someone not so nice.

Shortly after the sale, the new owner wrote to the tenant asking for rent for the additional space. The tenant had sensibly ensured that its lease was registered. The arrangement regarding the rent free use of the additional area was documented in writing between the tenant and the previous owner, but unfortunately not mentioned in the lease. Of course the new owner claimed it knew nothing of this arrangement and insisted on the additional rent.
