David Brackett
For nearly 30 years, David Brackett has skillfully resolved disputes for his clients through trial and appellate advocacy. He represents individuals and business organizations in courts nationwide, and his extensive experience as counsel for both plaintiffs and defendants gives him valuable insight and perspective in handling his cases.
David’s practice focuses on complex, high-stakes litigation, including class actions and multi-district litigation. David has handled cases involving contract disputes, corporate governance, business torts, securities law, false claims, intellectual property, trade secrets, and racketeering.
David frequently advises fellow lawyers and their law firms when they encounter complex problems in their cases.
In addition to his legal practice, David has served as an adjunct professor at Georgia State University's College of Law and Emory University School of Law, teaching courses on commercial arbitration and pretrial procedure.
Outside the office, David actively engages with his community. He served as board chair of Intown Collaborative Ministries (now Intown Cares), a nonprofit combating homelessness and hunger in Atlanta. He also serves as a board member for Georgia Appleseed Center for Law & Justice, a nonprofit increasing justice through law and policy reform and community engagement.

John E. Floyd
John Floyd was recently described by a client as “probably the leading authority on racketeering in the U.S.” He has a great depth of knowledge and experience in this complex area. Peers say he is “extremely bright, knowledgeable, and also very practical on how to get the best results for the client.”
John authored the preeminent book on state Racketeer Influenced and Corrupt Organizations (RICO) statutes, RICO State By State: A Guide to Litigation Under the State Racketeering Statutes (American Bar Association, Section of Antitrust Law, 2011 and 1998). He has also written numerous book chapters and articles on federal and state RICO.
The challenges of successfully pursuing and defending RICO cases are considerable. John has handled these cases in federal and state courts on behalf of plaintiffs, defendants, and as a special prosecutor in cases that have attracted national attention. He recognizes and understands the challenges and opportunities that these cases present.
A former Georgia Attorney General once said of John, “When you have a complex RICO question, you get John Floyd’s book and try to figure it out. If you can’t figure it out, you call John.” He has also been described as an “endless education” and “incredibly knowledgeable,” while “nobody outworks him.”
John is a frequent lecturer and has served as chair of Georgia’s ICLE RICO Seminar since its inception. John is often asked to speak to prosecutors and law enforcement organizations on RICO, gang prosecutions, and white collar crime topics.
John also has extensive experience with cases under the False Claims Act. This has included cases on behalf of both relators and defendants, including a case that generated civil and criminal recoveries totaling $600 million.
In addition to his RICO and False Claims Act work, John conducts internal investigations for institutional clients and represents plaintiffs and defendants at the trial and appellate levels in cases involving business torts and professional liability.
John is a Senior Fellow in the Litigation Counsel of America, which is an invitation-only trial lawyer honorary society and represents less than one-half of one percent of American lawyers. Fellows are selected based upon excellence and accomplishments in litigation trial work and superior ethical reputation.

Benjamin E. Fox
Ben Fox represents clients in litigation and investigations involving allegations of fraud and white collar crime. His civil practice concentrates on actions brought under the False Claims Act, RICO Act, Sarbanes-Oxley Act, Computer Fraud and Abuse Act, and other fraud-based private causes of action. Ben also specializes in conducting internal investigations and representing organizations during government investigations involving health care fraud, securities fraud, bankruptcy fraud, and tax fraud.
While a majority of his practice involves defending corporations and executives accused of fraud, Ben also represents a small number of whistleblowers in federal and state False Claims Act cases.
He is also a frequent writer and speaker for various professional-interest organizations and publications, such as the Georgia Institute of Continuing Legal Education (ICLE), ABA books and periodicals, Civil RICO Report, and the Atlanta Business Chronicle.

Frank Lowry
Frank has over 30 years of experience representing plaintiffs and defendants in complex litigation at the trial and appellate level in state and federal courts. He has spent his career at the firm after clerking for the Honorable Stanley F. Birch, United States Court of Appeals for the Eleventh Circuit. Frank handles a limited number of matters at a time so that he can be directly involved in all crucial phases of the litigation, from investigation and discovery to legal strategy and written advocacy, continuing through trial and appeal.
On the plaintiff’s side, Frank has led teams to nine-figure judgments and settlements and served on core trial teams producing ten-figure verdicts. On the defense side, Frank has served as lead counsel for some of Georgia’s most well-respected corporate citizens facing large potential exposures in class actions and other high-risk disputes.
Based on peer review and market data, Chambers and Partners ranks Bondurant as a “Band One” Georgia Firm for General Commercial Litigation and rates Frank as one of only two “Band One” commercial litigators in the state. Best Lawyers also selected him as the 2026 “Lawyer of the Year” for Bet-the-Company Litigation.
Antitrust law is a particular area of focus, in which Frank has served as lead counsel in defending and prosecuting plaintiff’s class actions, pursuing single-plaintiff antitrust claims on behalf of large institutions, and defending merger challenges by the Federal Trade Commission and Department of Justice. Frank has been recommended for antitrust litigation by Chambers for over a decade, and Chambers currently ranks him as one of only five “Band One” antitrust litigators in Georgia, while also recognizing Bondurant as one of just four “Band One” antitrust litigation firms in the state. Best Lawyers in America recognized Frank as the 2016, 2019, 2020, and 2025 “Lawyer of the Year” for antitrust litigation.
At the appellate level, Frank represents the firm’s clients in high-stakes appeals in the federal circuit courts and Georgia’s appellate courts. These include large-exposure appeals involving business torts, contract disputes, federal statutory claims (particularly antitrust, consumer class action, and RICO cases), catastrophic injury, and wrongful death. He is a founding member of Georgia’s State Bar Appellate Practice Section, a member of the Eleventh Circuit Historical Society, and a veteran invitee to appear in the annual demonstration argument presented at the Eleventh Circuit Appellate Practice Institute (ECAPI). He is one of only six Georgia members of the American Academy of Appellate Lawyers — an invitation-only counterpart to the American College of Trial Lawyers — and he is proud to say that two of the other members practice alongside him at Bondurant. Best Lawyers recognized Frank as the 2018, 2024, and 2026 “Lawyer of the Year” for appellate practice.

Ben previously served as in-house counsel at The Home Depot, managing a litigation portfolio centered on corporate recoveries and handling compliance and investigation matters across the enterprise.
