About
The firm: VILTOFT is a boutique firm of highly specialised attorneys known in particular for their work in construction, real estate, competition/European law and dispute resolution. VILTOFT enjoys a reputation among clients and peers for being among the very best within its practice areas.
Areas of practice
Construction: For more than 50 years, VILTOFT has been a leading provider of legal services to the construction industry. The firm provides advice and representation to employers, contractors, architects, engineers, insurance companies, and investors, and has been involved in most significant construction and engineering projects in Denmark over the past several decades. VILTOFT’s team also advises clients on cross-border projects based on international standard contracts such as FIDIC.
Construction has been the cornerstone of our firm since its inception. We have developed a deep knowledge and understanding of the industry that set us apart from most other law firms in this field.
Real estate: VILTOFT provides specialised, value-adding advice across all areas of real estate. We advise on project development, real estate transactions, residential and commercial lease law, and other real estate matters, serving major market participants.
In project development, we advise on the acquisition of building rights, infrastructure development, planning issues, development agreements, the negotiation and conclusion of lease agreements, and the transfer of properties as turnkey assets. We are also highly specialised in real estate transactions (real estate M&A).
Public procurement: We have a dedicated team of highly specialised attorneys who provide advice on public procurement.
We have many years of experience in planning and structuring public procurement processes tailored to our clients’ needs. We advise on all stages of the procurement process – from tender design and market dialogue to the preparation of tender documents, calls for tenders, and the handling of procurement complaints. We also advise on public-private partnerships (PPPs), early contractor involvement, and alternative types of collaboration.
Dispute resolution: Dispute resolution is one of our core areas of expertise. We represent clients in litigation, arbitration, and proceedings before various boards of appeal across a wide range of legal fields. Additionally, we assist with other forms of dispute resolution, such as mediation and conciliation.
Our services cover the entire process – from advising clients on whether to pursue legal action to assisting with evidence collection and managing the proceedings. We often represent clients in construction-related disputes before the courts and the Danish Building and Construction Arbitration Board. Our clients include employers, contractors, technical consultants, and insurance companies involved in disputes over defects, delays, disruptions, additional claims, and liability. We also represent contracting authorities and complainants in public procurement disputes before the Danish Complaints Board for Public Procurement. Furthermore, we act in cases concerning all aspects of real estate transactions, development, and both residential and commercial tenancy law.
Publications: VILTOFT’s partners have published leading textbooks on construction law and arbitration in Denmark: ‘ABR 18 – General Conditions for consulting services within the building and construction industry’ (by Michael Gjedde-Nielsen, Henrik Hauge Andersen, Steen Hellmann, Peter Fauerholdt Thommesen and Morten Ruben Brage; 1st ed. 2021), ’ABR 89 – General Conditions for consulting services within the building and construction industry’ (by Michael Gjedde-Nielsen and Hans Lykke Hansen; 3rd ed. 2013) and ‘Danish Arbitration’ (by Jakob Juul and Peter Fauerholdt Thommesen; 3rd ed. 2017).
