The Investigations Division of the CNC has decided to extend the research currently being carried out in the asphalt sector to Burgos-based construction firm Conalvi S.L., within the framework of the infringement procedure initiated on 17 December 2009, for practices prohibited by Article 1 of the Spanish Competition Act, 2007.
The opening of this infringement procedure was the result of an undisclosed investigation by the Investigations Divisions following a complaint lodged with the CNC and the consequent inspections conducted on 15 October 2009 at the headquarters of various companies active in the asphalt sector.
The aim of these inspections was to verify the existence, if any, of potential conduct and actions of the involved companies that could constitute restrictive practices prohibited by Article 1 of the Spanish Competition Act, consisting of agreements for market sharing and price fixing in the asphalt market and related products, and also to verify whether these agreements were put into practice.
According to the CNC press release, the 18 month deadline for a decision of the Council of the CNC that began on 17 December 2009 continues to remain in force.
