The Commission de Surveillance du Secteur Financier published on March 12th 2013 the 18 page form for assessment and confirmation of compliance with circular CSSF 12/546 on the authorisation and organisation of Luxembourg management companies and investment companies which have not designated a management company (the "Form").
The Form shall be filled in by management companies subject to Chapter 15 of the Law of December 17th 2010 relating to undertakings for collective investment (the "UCITS Law") as well as by investment companies which have not designated a management company within the meaning of Article 27 of the UCITS Law.
The information requested in the Form may further be completed by any other information the relevant structure may deem necessary and is subject to additional requests for clarifications by the CSSF.
The deadline for filing the Form with the CSSF is April 15th 2013.
Non EU AIFMs who market their funds to European investors will also be impacted by the Guidelines upon the end of the term of the transitional period applicable to such non EU AIFMs.
