On 22 December 1998, the European Commission adopted two Regulations, which modernise and simplify its competition procedures. These new Regulations will enter into force on 1 February 1999 and will replace five Commission Regulations (Commission Regulations (EEC) No 99/63, No 1629/69, No 1630/69, No 4260/88 and No 4261/88).
The first Regulation (EC) No 2842/98 on the hearing of parties in competition proceedings replaced Commission Regulation (EEC) No 99/63. This Regulation applies to all anti-trust cases including transport cases (inland, maritime and air transport) and describes how the Commission protects the procedural rights of parties such as the access to the file.
The second Regulation (EC) No 2843/98 on the form, content and other details of applications and notifications (provided for in Council Regulations (EEC) No 1017/68, No 4056/86 and No 3975/87) applies the competition rules to the transport sector. This new text simplifies procedures, which must be followed by companies in order to notify the restrictive agreements in this sector. Thus, the language used in request forms is the procedural language of the applicants and applications must be complete in order to be valid.
Moreover the new Form TR as the A/B and CO Form specifies the information that must be communicated by the notifying companies. This Form enables the Commission to examine restrictive agreements without having to request further information.
