  • Instructed to represent GENERALI ESPAÑA, S.A. CÍA DE SEGUROS Y REASEGUROS in the coverage dispute brought by its Insured (Spanish Engineering company) before the Spanish Courts. The dispute arises out from the construction of an off shore platform in Denmark, in which the Insured was contracted by the owner of the project to construct two wellhead platforms. The owner issued proceedings against the Insured in the UK seeking indemnity of the costs incurred to solve the design errors found in the Jackets of the platforms and to repair the defective works performed in the Topsides of the platforms. These claims were finally settled by the Insured by virtue of an out-of-Court agreement. The Insured is now seeking recovery under the policy underwritten with PI Insurers not only of the amounts settled with the owner of the project but also of the defence costs incurred in defending the claim before the UK Courts. Trial took place in July 2019; judgment is currently awaited.
