The stable: Ampersand is a leading civil law set offering unrivalled strength across its specialist practice areas. The practice areas are commercial, planning, public and reparation law (including professional liability). Ampersand is also well-placed to deal with cases that raise other civil law issues outside of these four specialist practice areas.

Ampersand has 56 counsel, including 25 Queen’s Counsel, many of whom are recognised as leaders in their respective fields. Members have sat as temporary judge in the Court of Session, part-time sheriffs, tribunal chairs and arbiters, experts and mediators. A number of members are or have been appointed as standing counsel to the Scottish Government and advocate general for Scotland. A number of members are members of the bar in England and Wales and South Africa.

Amongst Ampersand’s members are some of the Scottish Bar’s most highly rated and successful Queen’s Counsel and junior Counsel. Members are instructed by UK and overseas law firms, by governmental and in-house legal departments and by other professionals and consultants able to instruct counsel directly.

The clerks place great emphasis on their service to solicitors and clients and are always happy to advise what expertise is available among the membership in order to deal with a particular issue, in a specified timescale and at what cost.

Types of work undertaken: Ampersand has formidable strength in the fields of commercial law, planning and environmental law, public law and human rights, personal injury and medical and professional liability work. In the commercial sphere, there is particular expertise in relation to corporate law, construction and engineering litigation, contractual disputes and commercial property issues. In addition, expert assistance is available in relation to IP matters, media and defamation and employment cases. Ampersand is widely recognised as the leading set in professional liability at the Scottish Bar. Members are regularly instructed to represent private individuals, NHS trusts, medical defence unions and private hospitals. Members have been responsible for some of the most important and complex cases in this field, including claims involving brain and spinal injuries and other catastrophic medical injuries, multi-party claims arising from the use of medical products and equipment, human rights, mental health issues and medical ethics. Members have acted in cases and at tribunal and disciplinary hearings concerning potential negligence or misconduct involving accountants, architects, conveyancers, pension trustees, solicitors and surveyors. Ampersand has one of the largest personal injury practices at the Scottish Bar covering the whole range of personal injury cases, with wide experience of advising on and appearing in claims arising out of accidents at work, industrial disease, product liability, occupier’s liability, holiday claims and road traffic accidents. Members regularly appear for both pursuers and defenders in the leading personal injury law cases in the Sheriff Courts, the Court of Session and the UK Supreme Court. In the public law and human rights arena, the work of the stable is extensive, with members acting both for and against central government agencies, the Scottish Government, local authorities and regulatory bodies. Ampersand has built a growing reputation in the field of planning and environmental law with members at the forefront of developments in these areas, advising on all aspects of planning issues including statutory consents procedures, the environmental protection regime, compulsory purchase and compensation claims. Members are instructed in major inquiries for all those with an interest in the planning process, including promoters, objectors, consultees and decision-makers. Members regularly appear in planning appeals and judicial review applications involving planning and environmental matters. The firm’s planning counsel have unparalleled experience in renewable energy and energy related infrastructure legislation. Members of the stable practise in all the Scottish civil courts, as well as in tribunals, inquiries, arbitrations, adjudications and mediations. Members are also regularly instructed to appear in the UK Supreme Court the European Court of Justice and the European Court of Human Rights.
