Position

David’s work at the Bar includes all areas of personal injury work, including cases involving accidents abroad and accidents offshore. He is instructed on behalf of pursuers and defenders. He is also regularly instructed for pursuers in a wide range of medical negligence cases, often involving high-value claims, eg birth trauma, neurological damage. Significant personal injury cases of note include: McGhee v Diageo [2008] CSOH 74 (one of the first Scottish cases to consider the new approach to future wage loss under the Ogden Tables); McMahon v Dear 2014 SLT 823 (consideration of the nature and extent of duties which a competitor in a sporting event might owe to spectators and other competitors); Grant v Fife Council 2013 Rep. LR 73 (debate on whether an employee on an assault course as part of a team building event was ‘acting in the course of his employment’); Smith v Sabre Insurance 2013 SC 569 (appeal hearing on res Judicata); Vaickuviene v J. Sainsbury plc 2014 SC 147 (appeal hearing on the nature of a ‘close connection’ for the purpose of a vicarious liability for harassment); and Wilson v North Star Shipping Ltd [2014] CSOH 156 (proof dealing with the application of the Merchant Shipping and Fishing Vessels Regulations); Tessa Till v Tayside Public Transport Ltd. [2017] CSOH 6 (reviewing recent case law on contributory negligence and pedestrians). Reported clinical negligence cases of note include: McEleney v Ohri [2007] CSOH 203 (cauda equina syndrome); KT v Lothian NHS Board [2009] CSOH 132 (cerebral palsy); and G v Greater Glasgow Health Board [2013] CSOH 145 (cerebral palsy).
