Position

James’ primary specialisms include counter fraud, personal injury and costs. He has an outstanding motor insurance fraud practice, appearing in reported cases in both the High Court and Court of Appeal.

The insurance operations in which James has acted in the last year have included combatting insurance fraud rings which involve suspect: fraud rings; staged collisions; vehicle occupancy; fictional or exaggerated injuries; and fraudulent credit hire claims. He has obtained declarations of fundamental dishonesty both by way of standalone applications and at the conclusion of trials.

James has a particular expertise advising and representing defendant insurers who are dealing with claims in which fraud and/or fundamental dishonesty are suspected. James has been instructed by market leading UK motor insurers as Lead Counsel in large scale motor insurance operations which have individually involved up to 100 suspect claims, and have had reserves of up to £2 Million. This work requires the consideration of not only the merits and strategy in each individual claim which is included within a specific operation’s remit, but also, an insurer’s overall operational strategy when dealing with numerous linked claims in different courts across the UK.
