Position

Stuart is a specialist extradition barrister. He represents both Requested Persons and Judicial Authorities and regularly appears at Westminster Magistrates’ Court and on appeal at the High Court.

He also has considerable experience as a criminal advocate and is a Grade 3 panel advocate for the CPS.

Stuart has experience of both defence and prosecution work having started his career as an accredited police station representative in the Thames Valley, qualifying as a Solicitor Advocate. He transferred to the Bar and moved to the CPS initially as a Senior Crown Prosecutor in Thames and Chiltern CPS (Reading) for the period 2007-2011, where he developed specialisms in RASSO work and as a Youth court Prosecutor.

He held bespoke roles as CPS area lead on football banning orders and the Prosecutor with responsibility for peace protestor cases emanating from AWE Aldermaston. He was seconded to the Complex Casework Unit and then became a District Crown Prosecutor managing the Oxford Crown Court Unit. He spent the period 2011-2018 working in the Special Crime and Counter Terrorism Division and then the International Justice and Organised Crime Division. He has had conduct of some of the most sensitive cases conducted by the CPS, latterly as a Specialist Prosecutor allocated to the Extradition Unit. He has extensive experience both as advocate and litigator in export and import extradition cases both within the EU but with a particular specialism in requests under the Council of Europe convention, the London scheme and bilateral treaty based requests.

In the wake of the Brexit vote he was seconded to CPS Private Office to head up the CPS EU Portfolio. In doing so he was responsible for CPS Brexit planning and the implementation of the European Investigation Order training prosecutors across the UK. He represented the UK at the EU commission’s working group on the EAW. He is Vice Chair of the UK Extradition Lawyers Association. Throughout this period he has maintained a criminal practice alongside his extradition practice. He wrote CPS legal guidance for the prosecution of unregistered independent schools. He worked as a Crown Advocate for CPS London and was seconded as a Legal Inspector to HM CPS Inspectorate. Through this role he has extensive experience of writing and editing reports for publication.
