Position
Gerard is a partner in the clinical law team. He advises NHS and private health firm clients on various health law issues, with specific expertise in the areas of public law, information law, regulatory issues and inquests. Issues covered by Gerard include consultation considerations, commissioning arrangements, eligibility criteria for treatment and judicial reviews. Gerard also heads Capsticks information law team and advises a number of NHS and public bodies on their information governance arrangements and policies. In terms of information law advice, Gerard regularly gives advice to clients on DPA, FOIA and confidentiality issues. His advice on regulatory matters includes concerns over health professionals’ performances, as well as care and quality issues for the provision of health and social care. Gerard’s inquest work includes advice and representation and it is regularly provided to both NHS and private clients. Gerard has also advised both NHS bodies and independent inquiries on legal issues when they are investigating NHS body’s governance arrangements.
