Benoît specializes in banking and finance law as well as in regulatory insurance law. He mainly advises lenders and borrowers on financial transactions, including acquisition finance, syndicated loans, real estate finance, debt restructuring, etc.
Benoît also advises financial institutions (banks, investment funds, investment firms, insurance undertakings, pension funds, payment institutions) and public authorities, both in the performance of their day-to-day activities (securitization, capital market transactions, investment products, liability of financial institutions) and in their relationships with the regulatory authorities (licensing, prudential requirements, merger and acquisition).

He is regularly consulted by regulated entities on regulatory compliance matters. Benoît also developed an in-depth knowledge in advising insurance undertakings with their operations in Belgium in the context of Brexit.

He was seconded to the banking and finance team of CMS London.

The team is particularly well versed in providing regulatory advice on cross-border fintech transactions and partnerships as well as on Belgian market entries. Benoît Vandervelde assists financial institutions and fintech companies with regulatory matters, with an increasing focus on the crypto space; he co-heads the team with electronic communications and competition specialist Dirk Van Liedekerke and data privacy expert Tom De Cordier.

Belgium > Banking, finance and capital markets

Real estate lending represents a cornerstone of the offering at CMS, which advises large Belgian, French and German banks as well as corporate and private equity borrowers in connection with high-value debt finance transactions. The team is also very active in the green financing space and handles a variety of debt capital markets matters as well as acquisition finance mandates. Financial regulatory matters are a further area of focus, with practice head Benoît Vandervelde advising several financial institutions and payment services providers on domestic compliance issues. Vandervelde is also a key contact for syndicated lending, as is real estate finance expert Bruno Duquesne.
