José Miguel has extensive experience in civil and commercial litigation and arbitration, national as well as international, including antitrust, bankruptcy and customs litigation. He teaches Civil Law at Universidad de Chile. He has lectured torts, Civil Procedure and International Dispute Resolution at different universities. He is the author of "Cost Allocation and Pecuniary Sanction Rules: Economic Analysis for the Chilean Civil Procedure Reform" (Sistemas Judiciales, CEJA, Number 13, 2008); and co-author of "Antitrust Law, Antitrust Court Jurisprudence" (Volume X, Lexis Nexis, 2002); "Antitrust Law, Antitrust Court Jurisprudence" (Volume XI, Lexis Nexis, 2002); and "Law as a Creation of Art or The Law Form" (Law and Humanities Journal, Universidad de Chile, 1999). He won the Societys 2008 Pro Bono Award , New York, for outstanding service to Legal Aid Society and its clients. He was also admitted to practice in New York. He joined Claro & Cia. in 1996. Previously he was also with Shearman & Sterling in New York, 2007and 2008, and became partner in 2012.

Claro & Cia. is highly rated for significant merger clearances, competition-related litigation and negotiations with Chile’s antitrust authorities; and the practice group fields lawyers with specific industry strength in banking and finance, transportation and energy. Cristóbal Eyzaguirre and José Miguel Huerta, who is ‘highly committed, strategic and has excellent competition law skills’, represented Compañía Sud Americana de Vapores in a leniency application before the Chilean Antitrust Agency relating to the car carrier industry. In other matters, the team advised LATAM Airlines Group and International Consolidated Airlines Group in non-contentious proceedings initiated by the Chilean Association of Tourism Companies before the TDLC, regarding two joint business agreements. Claro & Cia. is widely respected for its handling of civil and commercial law disputes, as well as domestic and international arbitration. Other areas of strength include labour, tax and administrative litigation and the team also features lawyers with experience in white-collar crime matters. The team led advice to AES Gener on several arbitrations and court cases against Chilean energy group CGE, regarding the amendment of power purchase agreements (PPAs) pursuant to regulatory changes; and also assisted Chilean commercial bank Corpbanca with fines imposed by the local regulator (SBIF) for alleged violation of individual credit limits. Other matters include defending major poultry producer AGROSUPER in class action litigation brought by the national consumer agency, SERNAC on grounds of alleged cartel activity; and on the arbitral front, representing Publicis in $70m proceedings against its former commercial partner. José María Eyzaguirre G, practice head Cristóbal Eyzaguirre, Felipe Ossa, Nicolás Luco and José Miguel Huerta are the names to note; while Santiago Bravo and Tomás Kreft are highly regarded associates.
