Corporate reorganisation and bankruptcy.

Position

Marc is a US qualified partner in the corporate reorganisation and bankruptcy group in London. His practice includes work-outs and restructurings involving various types of securitisations, structured finance transactions and syndicated leveraged finance transactions. He has represented investors (including committees), debtors, arrangers, underwriters and credit enhancers (including monoline insurance companies) in a wide variety of asset-backed and structured finance transactions and restructurings of those transactions. Some recent engagements have included restructuring advice in connection with distressed structured investment vehicles (SIVs), collateralised fund obligations (CFOs), non-conforming residential mortgage-backed securities (RMBS), commercial mortgage-backed securities (CMBS) and portfolios of non-performing loans (NPLs). These matters frequently involve the resolution of intercreditor issues and collaboration with the firm’s litigation practice area. Marc has participated in teams at the firm which have had significant roles in each of the following reported cases: Bank of New York v Montana Board of Investments (Orion) [2008] EWHC 1594 (Ch); Perpetual Trustee Company Limited and Belmont Park Investments Pty Limited v BNY Corporate Trustee Services Limited and Lehman Brothers Special Financing Inc. (Perpetual) [2009] EWCA civ 1160; and BNY Corporate Trustee Services Limited and Eurosail-UK 2007-3BL Plc (Eurosail) [2011] EWCA civ 227.
