Position

Mr. Thomas has a national practice in the telecommunications and broadband communications industries, and in cyber and data security. His practice focuses on the deployment and operations of competitive wire-based and wireless networks and services, with a particular emphasis on the mesh of federal, state and local regulations surrounding broadband networks in matters involving network operations and security, local franchising, rights-of-way and infrastructure.

Career

During his more than 25 years as counsel to the nation's top cable and broadband companies, cable and telecommunications trade associations, and other business organizations, and having handled cases in approximately 40 states, Mr. Thomas is a nationally recognized authority on utility and telecommunications infrastructure, pole attachments, rights-of-way, federal, state and local broadband and telecommunications regulatory and communications plant deployment issues and public utility law. Mr. Thomas has handled a wide range of regulatory, litigation, and transactional matters involving telecommunications providers, broadcasters, satellite communications, federal, state and local licensing and permitting, data security and privacy and spectrum use. He has litigated before the U.S. Federal Communications Commission (FCC), numerous state public service commissions and federal and state courts. In addition to those bodies, he regularly appears before state legislatures and county and municipal governments.

Sheppard, Mullin, Richter & Hampton LLP is particularly strong in cross-border, CFIUS and national security work, with a client list that includes satellite operators such as OneWeb and Omnispace, and private equity clients such as I Squared Capital and Astra Capital Management. Team leader Brian Weimer focuses on satellite, wireless and broadcast companies, providing transactional and regulatory advice, as well as representation in FCC enforcement and national security proceedings. Weimer represents Korean satellite operator KTSAT in arbitration and litigation proceedings concerning satellite ownership and related damages, along with telecoms litigation specialist Paul Werner. Werner has experience in large-scale domestic consumer protection matters, with a particular emphasis on privacy matters, as well as arbitration and international disputes; he serves as regulatory counsel to social network and media company Snap. Weimer and Werner also advised NESS Technologies on a dispute with Chinese conglomerate HNA Group, raising novel issues concerning the CFIUS process, and on a purchase agreement for Ness' digital solutions business. Focusing on broadband, cable and wireless issues, Dave Thomas is the key contact for Charter Communications; he advises the client on wireless infrastructure deployment, cable operational issues, the FCC's one-touch infrastructure policies, and net neutrality. Other key team members include cable specialist Ray Rutngamlug and associate Drew Svor. Aaron George recently departed the firm for an in-house position.
