Brian Burke, counsel in the Litigation Group, regularly advises multinational corporations and financial institutions in all stages of complex litigation, investigations and regulatory enforcement proceedings. As a fluent Mandarin speaker, Mr. Burke focuses in particular on advising multinationals with operations or subsidiaries in Greater China in the areas of shareholder litigation, FCPA/anti-corruption, antitrust, economic sanctions, anti-money laundering and other regulatory and investigative matters. Mr. Burke has appeared before federal and state judges and U.S. regulators in securities, antirust, white-collar and other complex litigation and regulatory proceedings, including representing companies in multi-jurisdictional investigations by the Securities and Exchange Commission and the Department of Justice. Mr. Burke also has taken and defended depositions of Mandarin-speaking witnesses in the United States and Hong Kong and has prepared dozens of witnesses for trial and grand jury testimony. Mr. Burke frequently conducts compliance training and seminars throughout Asia addressing cross-border risks commonly encountered in the region.

Burke's China-focused investigations group has also handled various multijurisdictional anti-corruption investigations for clients including Louis Vuitton Moet Hennessy, RELX Group and Medtronic. In addition to its large-scale investigations mandates, the team is retained by clients such as the Valeo Group to advise on ongoing anti-corruption compliance concerns.

Shearman & Sterling's team is headed by Brian Burke, who splits his time between Shanghai and New York. It acts for clients including Medtronic, Bulgari and PetroChina and has conducted over 20 internal investigations in China for GlaxoSmithKline as part of its advice on a landmark criminal bribery investigation in China, the first time a foreign company faced criminal charges in China. The case triggered simultaneous investigations by the DOJ, SEC and SFO. The team now handles all of the client's anti-corruption investigations in China. Associate Leo Tian is a name to note in Hong Kong.
