Richard Spehr is the Managing Partner of Mayer Brown's New York office. Named one of New York's Super Lawyers, Rich is an experienced trial lawyer whose practice focuses on complex commercial litigation, including federal and state securities laws, internal investigations, SEC investigations, international arbitration (ICC, CEDR, LCIA, UNCITRAL), derivatives, banking, and financial services. Rich’s clients include Ally Financial, Bank of America, Morgan Stanley, HSBC, GSK, BMW, and Bristol-Myers Squibb. Recent notable representations include: RMBS litigation (Ally / HSBC), international arbitration (Schering-Plough, BMS); lender liability (HSBC); commodities trading (Lehman Brothers); foreign exchange trading (Bank of America, CMC Group); securities litigation (TV Azteca, Procom, Inc., Collins & Aikman, ING Securities, Inc., Twinlab Corporation, and numerous issuers in the IPO laddering/allocation cases); federal and state consumer protection (BMW); derivatives (BMO); CBO-securitization (Bank of America); fraudulent conveyence (Bank of America); litigation diligence (CS First Boston); real estate work out (Morgan Stanley); unfair trade practices (Hampshire Equity Partners); mergers and acquisitions (CIBC); securities arbitration (CIBC); and numerous SEC and New York AG investigations on behalf of issuers, directors, and officers. Mayer Brown’s New York securities litigation team is ‘highly responsive, very detail oriented and provides high-value advice from subject matter experts’. Joseph De Simone, Richard Spehr and Steven Wolowitz (who is a ‘thought leader and an expert in his field’) are the key partners in the practice. The firm, which was heavily involved in securities litigation arising from the global financial crisis, is noted for the close integration of its litigation, investigation and enforcement capabilities. Its highlights included the work of Christopher Houpt, Michael Martinez and Matthew Ingber for Bank of New York Mellon in cases related to its role as trustee of RMBS transactions. In re The Bank of New York Mellon saw the bank settle claims for $8.5bn, the largest private settlement in history, but litigation continues in regard to how the settlement is distributed. In another key case, Wolowitz advised Société Générale on class actions alleging manipulation of reference rates including Libor. Michele Odorizzi in Chicago is also recommended.
