Brad Benoit's practice focuses on complex commercial litigation. He has counseled and represented clients in diverse matters, including contractual disputes, business torts, energy-related litigation, and bankruptcy-related litigation. Mr. Benoit has represented corporations and individuals on a contingency fee basis in many contexts, including representation of litigation trusts in claims against former equity owners, directors and officers of insolvent entities. He has tried cases in federal court, state court, and arbitration, and he has argued multiple appeals.

Stephen Benesh at Bracewell LLP in Austin has ‘exceptional foresight, a focus on the details and a strong strategic view’. Stephen Crain and Bradley Benoit in Houston acted for Pier 1 Imports in a securities fraud class action filed in Texas and saw all claims dismissed.

Bracewell LLP’s ‘very good’ practice is well versed in commercial disputes in the conventional power arena and handles a steady flow of FERC proceedings for a broad client roster, including Hydro One, Powerex and GDF SUEZ Energy North America (ENGIE). Houston-based Bryan Dumesnil and Bradley Benoit are defending Southern Copper and its directors against damages claims brought by a putative class of shareholders; the case is related to the ownership transfer of a subsidiary with two power plants, the execution of a power purchase agreement and the restructuring of a line credit for the power plants‘ construction. In other work, David Perlman represented Shell Energy North America in a FERC settlement regarding refunds for short-term energy sales during the 2000-2001 California energy crisis and Jeffrey Holmstead acted for member-owned electric cooperative Tri-State in a contentious proceeding challenging two EPA rules that would have prevented the construction of two coal-fired plants. Stephen Crain heads the team, which recently welcomed David Super from Baker Botts L.L.P. and Paul Wight from Skadden, Arps, Slate, Meagher & Flom LLP.

Bradley Benoit is defending HPS Investment Partners and Kingfisher Midstream against claims of tortious inference, civil conspiracy and unjust enrichment brought by Mustang Gas Products, while Sean Gorman is representing Manti Equity Partners in an arbitration related to reserved interest payment obligations.
