Tom is routinely instructed by landlords and managing agents to advise on rights and remedies in matters ranging from recovery of service charges, forfeiture (residential as well as commercial), breach of covenants and injunctive relief.

Tom has extensive experience in the following areas:

• Residential and commercial landlord and tenant disputes, including service charge, breach of covenant and trespass.
• Injunctions – including trespass and breach of covenant
• First-tier Tribunal cases – service charge, breach of covenant.
• Cases within the County Court, High Court and Business & Property Court.
• Advising on complex disputes, especially those relating to large and mixed-use schemes.

Career

Tom’s commercial background saw him advise high net worth individuals, SMEs as well as larger companies on a variety of topics such as privacy claims, phone hacking claims, shareholder and director actions as well as property disputes (both commercial and residential),

Notable highlights of Tom’s work include:

• Acting in a complex High Court claim concerning a property worth over £5million with allegations of promissory estoppel.
  • Acting for a former chairman of Watford FC to enforce a signed agreement to purchase Bolton Wanderers FC.
  • Successfully overturning a ‘super injunction’ brought by a Manchester United footballer.
  • Advising a RTM company on their rights in a disputed claim against an insurer-backed New Home Warranty due to defects arising after completion.
  • Telecommunications Act/1954 Act claim against the telecoms provider on behalf of the freeholder.
• Successfully obtaining an ex-parte injunction in a quasi-partnership dispute between farmer brothers.
• Successfully sought the High Court enforce an arbitral award that was based on a penalty clause in an agreement, the first known instance of this happening.
