Position

From a grounding in common law, Petar now undertakes employment work with extensive tribunal experience, personal injury and professional negligence claims, including clinical negligence and related claims under insurance policies. The major part of Petar’s work is employment, both in the tribunal and service agreements in relation to senior staff and directors including restrictive covenants. He has delivered employment seminars both as part of St Philips seminar programme and externally. He regularly represents employers (both private companies and public bodies) and employees in difficult and sometimes high profile multi-day cases. Areas covered include collective redundancies, TUPE, discrimination and Equal Pay Act claims. Petar also undertakes personal injury work including claims of work related stress. Petar is also a member of PIBA and has long experience in personal injury and clinical disputes, mainly undertaking claimant work. Recent experience in personal injury includes: cases involving serious head injuries resulting in changes in personality and cognitive disorders and necessitating long term care with consideration of periodical payment orders; serious orthopaedic and chest injuries necessitating Roberts v Johnstone claims; representing dependants upon a fatal accident of a medical practitioner with an established practice with issues over the treatment of business assets and pension and death benefits, resulting in a very substantial settlement after a JSM. Experience in clinical disputes includes: failure to diagnose aortic dissection causing premature death; failure to diagnose cancer promptly leading to death; failure to diagnose glaucoma leading to blindness; surgical negligence resulting in nerve damage and palsy to the hand; failure to advise leading to premature hysterectomy in a young woman; clinical negligence resulting in leg amputation of a young amateur sportsman with consideration of substantial claims for accommodation under Roberts v Johnstone, prosthetics including the provision of specialist sports prosthetics resulting in a very substantial settlement after a JSM; clinical negligence with the unusual issue of surgery (hysterectomy upon a young woman) being performed without her consent; cerebral palsy from failure to diagnose and treat hypoglycaemia during the neonatal period. Petar is licensed to undertake direct access work.
