Position

Prof. Dr Alexandra von Bismarck is a Partner in Fieldfisher’s Hamburg office and advises on all intellectual property rights, in particular in the areas of Trademark and Design Law, as well as Copyright and Competition Law.

She advises national and international companies from a wide range of sectors. Her particular expertise lies in the field of Intellectual Property Law with a focus on Trademark and Design Law as well as Competition Law.

In the course of assisting start-ups as well as global brand portfolios, she supports her clients in finding trademarks, designs and company names, conduct corresponding availability searches and advises on the development of application strategies as well as on the securing, exploitation and enforcement of IP rights in Germany, the EU and worldwide.

She advises on agreements on the delimitation of prior rights, on licensing as well as on purchase and merchandising agreements and regularly represents national and international companies in proceedings before the European Union Intellectual Property Office (EUIPO) in Alicante, the World Intellectual Property Organization (WIPO) in Geneva, the German Patent and Trade Mark Office (DPMA) and in appeal proceedings before the Federal Patent Court (BPatG) in Munich, as well as in proceedings before German courts and the Court of Justice of the European Union (ECJ) in trade mark, design and competition law actions.

Her expertise is regularly mentioned in JUVE, Who’s Who Legal Trade Marks, Best Lawyers/Handelsblatt, Chambers Europe and Chambers Global.

Career

Prior to joining Fieldfisher, she worked for eight years at a leading German IP boutique in Hamburg.

She is an active member of the International Trade Mark Association (INTA), the European Communities Trade Mark Association (ECTA), the German-American Lawyers Association (DAJV), the German Association for the Protection of Intellectual Property (GRUR), the German Lawyers Association (DAV) and an honorary member of the German Association of Corporate Lawyers (BUJ).

Education

She studied at the Universities of Constance and Lausanne (Switzerland) and the London School of Economics (LSE) and completed her doctorate on a Trade Mark Law topic at the chair of the renowned Trade Mark lawyer, Prof. Dr. Karl-Heinz Fezer (University of Constance).

At the German Graduate School of Management and Law (GGS), an international business school in Heilbronn, she headed the Chair of German and European Business Law, Intellectual Property Law and IT Law from 2012-2021, as well as the Master’s programme “LL.M. in Legal Management” for corporate lawyers and the GGS’s Syndic Institute until 2016.
