DLA Piper ABBC adopts a ‘very hands-on approach’ and displays ‘creativity, resilience and grit’. Highlight work for the eight-strong team included handling the employment aspects of large acquisitions and related disputes, but the outfit covers the whole gamut of employment and social security matters. Benjamim Mendes is ‘the best employment lawyer in the Portuguese market. His seniority and knowledge when dealing with every stakeholder in the process make the difference’, according to one client. João Guedes is the other name to note.

Morais Leitão, Galvão Teles, Soares da Silva & Associados is noted for its ‘engagement, assertiveness and respect in the market’. It acts for a variety of companies, including start-ups. The ‘extraordinaryLuís Miguel Monteiro provides ongoing advice to Pfizer, ‘fantastic’ and ‘technically flawless’ managing associate Joana Almeida assisted Indorama with its acquisition of operational industrial assets from Artlant and Artelia, and Helena Tapp Barroso advised Impresa Group on the sale of its magazine portfolio. Practice head Pedro Pardal Goulão regularly acts for Tupperware.

PLMJ is ‘very close to its clients’ and lawyers are able to ‘simplify questions and think outside the box’. Domestic and international household names instruct the team. Nuno Ferreira Morgado ‘puts himself in the client's shoes’ and ‘gets straight to the point’; he assisted Toshiba with the redundancy of its sales manager in Portugal. The ‘very competent’ Tiago Cortes assisted TAP in negotiating a five-year collective agreement with the Pilots’ Union (SPAC). The well-established team at SRS Advogados features the highly regarded César Sá Esteves, Mariana Caldeira Sarávia and Ana Luísa Beirão. Handling mostly standalone work, and covering the full range of employment matters, the team commands a strong international network and has particular expertise in the finance, health and pharmaceutical, insurance, and aviation sectors. Maria de Lancastre Valente made partner.

Covering all aspects of employment law, a particular highlight for Abreu Advogados was representing Raríssimas in a high-profile case involving the dismissal of its founder and former president. ‘Flexible, customer-focused and results-oriented’, the team is led by Carmo Sousa Machado, Marta de Oliveira Pinto Trindade and Patrícia Perestrelo. The three-strong team at Campos Ferreira, Sá Carneiro & Associados can rely on a large roster of longstanding clients, providing ongoing advice as well as assistance with transactions, legal opinions and contentious matters. The 'fantasticPedro Furtado Martins is singled out.

CMS has a focus on matters with contentious or restructuring aspects and is experienced in handling union negotiations and corporate work. Cuatrecasas' team is ‘very well connected internally’. It assists with transactional work and renders ongoing advice to clients such as JD Sports and DHL. ‘Intellectual authority’ Maria da Glória Leitão heads the practice; senior associate Rui Vaz Pereira adopts ‘a very practical approach’ and is ‘very assertive in court’.

Garrigues Portugal is well-versed in collective procedures, although it handles the whole spectrum of employment matters. Clients include Spie Batignolles and Gomà-Camps. Rui Valente heads the practice; senior associate João Soares Almeida is another name to note.

The ‘very accessible’ team at pbbr - Sociedade de Advogados RL advises on restructurings, collective procedures, transactional work as well as disputes. Clients include Sanofi, ISS World Services, Abanca, Associated Press and American Airlines. The ‘excellentInês Reis leads the team; Bruno Soeiro Barbosa and associate Inês Oom de Sacadura are also recommended.

A young team handling sophisticated work, Uría Menéndez – Proença Carvalho is valued for its 'great know-how and experience' and 'assistance with global projects'. It acts for a range of banking clients, recently assisting Wizink Bank in a claim filed against the Labour Ministry concerning the interpretation of TUPE rules applied to the collective bargaining agreement within the context of the sale of Barclays’ card business to the client. Counsel André Nascimento, who ‘albeit young, is very good’, leads the team.

VDA handles the entire gamut of employment matters, including in other Portuguese-speaking jurisdictions. It is representing one of the largest Portuguese private security companies in a case concerning the application of an employment termination provision in the event of appointment to the board. Managing associate Américo Oliveira Fragoso is a ‘well-seasoned lawyer with deep academic knowledge’, and both managing associates Tiago Piló and Tiago Cochofel de Azevedo are ‘strong advisers’. Piló heads the team jointly with Rui Andrade.

João Salvador and Miguel Alcobia handle employment matters at Albuquerque & Associados, advising on restructuring, collective and individual bargaining and on executive contracts, with key clients coming from the chemical and automotive sectors, among others.

The ‘highly dedicatedInês Albuquerque e Castro heads the practice at FCB Sociedade de Advogados, which gives clients ‘the solutions they need and full guidance throughout the entire process’. It assisted IT services company CGI with all aspects regarding the collective dismissal of 70 employees, resulting in a company restructuring, and Bacardi with a transfer of operations.

Linklaters provides support in the context of financings and transactions, but also renders ongoing advice and handles terminations and disputes. It assists Plataforma de Negociação Integrada de Créditos Bancários with its employee allocation strategy across all the platform's banks. The young and growing team is headed by ‘excellent’ of counsel Marta Afonso Pereira. Associate Sílvia Pinheiro Esteves is also recommended.

SLCM | Serra Lopes, Cortes Martins & Associados is noted for its ‘knowledge, quality, and timeliness’. The team handles the full range of employment issues, including restructurings, litigation, audits and data protection, for clients such as SIBS, Globalmedia Group, and Sociedade Central de Cervejas. Ines Pinheiro's 'understanding of issues goes beyond the purely legal’. Senior associate Tiago Pestana de Vasconcelos is also singled out.

The lawyers at Caiado Guerreiro ‘really advise what is best for the company’ and explain matters in ‘simple language’. Led by Diogo Leote Nobre, the team at Miranda & Associados handles every aspect of employment law for a client roster that includes Falck, Egeac, Banco Santander Totta, Accenture, and Martifer. Leote Nobre is supported by of counsel Joana Vasconcelos, managing associate Paula Caldeira Dutschmann and associate Cláudia do Carmo Santos; the team also frequently draws on the firm’s international network.

The ‘persistent’ team at Raposo Bernardo handles a wide range of employment matters. Key clients include Iberostar Hotels & Resorts and Menarini Pharmaceutical. ‘Reliable and determined’ senior associate Ana Cláudia Rangel heads the practice.

    Law no. 13/2016, of 30 December 2016, which amended and republished the Mozambican VAT Code, was recently rectified by a Notice, dated June 8th.

    In order to clarify some of the new obligations stemming from the EU General Data Protection Regulation (“GDPR”), which will apply as of 25th May 2018, the Article 29 Working Party (“WP29”) – the independent European consulting body for data protection issues – recently issued its “Guidance on Data Protection Impact Assessment (“DPIA”)”. This document will be available for public consultation until 23rd May, 2017.

    On 28th January, 2017, the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados/CNPD) published a document establishing 10 measures for entities to prepare for the application of the General Data Protection Regulation (“GDPR”).

    Presidential Decree no. 193/17, which approves the Regulation on the Licensing of Establishments and of Commercial Activity and Market Services (“Regulation”), was published on 22 August. The Regulation, which will enter into force on 21 October (60 days after its publication), establishes the conditions and procedures governing the licensing of commercial activities and market services, as well as the licensing of the respective establishments, revoking Presidential Decree no. 288/10, of 30 November (Regulation on the Licensing of Commercial Activity and the Provision of Market Services), as well as all prior regulations on the matter contrary to the provisions of the new Regulation.

    Ministerial Statute 50/2017, of 11 July 2017, sets forth the measures approved by the Ministry of Mineral Resources and Energy to streamline petroleum products’ import into and supply to the country and ensure fuel supply safety, regularity and quality. The newly approved measures obviously have a direct impact on distributors, but also affect suppliers, IMOPETRO, commercial banks operating in-country and the Banco de Moçambique (“BdM”).
  • Mozambique VAT Code Amended

    Law no. 13/2016, of 30 December 2016, which amended and republished the Mozambican VAT Code, was recently rectified by a Notice, dated June 8th.

    Decree-Law 79/2017, of 30 June 2017, was published last Friday and amends both the Insolvency and Corporate Recovery Code and the Companies Code, in order to implement the goals of the “Programa Capitalizar” approved by Council of Ministers Resolution 42/2016, of 18 August 2016

    Please be aware that a new Presidential Decree has been published on 24th of April (Presidential Decree 79/17 of 24 April) which, among others, introduces the following significant amendments to former Presidential decree 43/17 of 6 March (regulations on the performance of a professional activity by nonresident foreign employees ):

    Bearer securities have been prohibited under Law 15/2017, of May 3, 2017, published today. The Companies Code and the Securities Code have been amended in order to implement this measure.

    Presidential Decree 43/17, of 6 March 2017 (“DP 43/17”) just enacted new regulations on the performance of a professional activity by non-resident foreign workers, repealing former Decrees 5/95, of 7 April 1995 and 6/01, of 19 January 2001.
