Career

Jason Swergold is an accomplished former federal prosecutor and trial attorney who represents clients in criminal and regulatory defense matters, government investigations, internal investigations, and complex commercial litigation. A trial-tested litigator with nearly a decade of government experience working with federal, state, and local law enforcement, Jason applies his aggressive and sophisticated trial skills to help clients solve a range of complex and sensitive legal problems. He co-leads the firm’s Criminal Defense & Investigations Practice and serves on the Last Minute Trial Team.

Prior to joining Yankwitt LLP, Jason served as an Assistant U.S. Attorney (AUSA) for the Southern District of New York for more than eight years. As an AUSA, he tried 12 federal criminal cases and argued 10 appeals before the U.S. Court of Appeals for the Second Circuit. Jason also served as Co-Chief of the Narcotics Unit, Acting Deputy Chief of the Violent and Organized Crimes Unit, and most recently, Deputy Chief of the White Plains Division, where he supervised all federal criminal prosecutions in Westchester, Rockland, Orange, Putnam, Dutchess, and Sullivan counties.

In these roles, Jason investigated, prosecuted and/or supervised a wide variety of complex cases involving racketeering, homicide, organized crime, labor union corruption, and gang-related and drug-related violence, international and domestic narcotics trafficking, sex trafficking, fraud, and firearms offenses.

Jason began his legal career as an Assistant Attorney General in the Massachusetts Attorney General’s Office and then as an associate at Shearman & Sterling LLP. While at Shearman and Sterling, he was part of the trial and appellate team that secured the reversal of a hedge fund manager’s insider trading conviction and dismissal of the indictment, as well as the vacatur of a state inmate’s death sentence.
