- Representing the plaintiffs in the Bears Ears National Monument Litigation. Bears Ears, designated by President Obama in 2016, was the first national monument developed and designated with direct involvement of Native American tribes through the Bears Ears Commission. In 2017, President Trump significantly reduced the size of the monument via presidential proclamation. Our team is actively involved in litigation over President Trump’s 2017 proclamation in the United States District Court for the District of Columbia (D.D.C.), and in the ensuing litigation related to President Biden’s redesignation of the Bears Ears National Monument.
- Successfully winning a critical, landmark Administrative Procedure Act appeal for Inhance Technologies in the U.S. Court of Appeals, Fifth Circuit, and in securing the rare dismissal of a related Toxic Substances Control Act (TSCA) prosecution brought by the United States Department of Justice. We also represented the client in an enforcement action brought by the Department of Justice (DOJ) in federal district court for alleged violations of TSCA and secured a rare dismissal of that enforcement action when the DOJ and citizen-intervenors determined it could no longer proceed in light of the Fifth Circuit’s decision.
