Representing Bai Brands, a subsidiary of Keurig Dr Pepper, in a putative class action filed in the Southern District of New York challenging the “No Artificial Sweeteners” claim on the Bai flavored waters. The plaintiff, now the second plaintiff in this action (the first withdrew), seeks to represent a class of all persons in New York who purchased any Bai water product bearing the statement and containing erythritol during the class period. The plaintiff has now moved to certify the class and Bai vigorously opposes.
