Hansberry Tomkiel is experienced in litigating competition cases before courts of all instances and is especially active in litigating private damage actions, both on behalf of plaintiffs and defendants. The team’s capabilities also encompass appeals over decisions of the Competition Authority. Małgorzata Krasnodębska-Tomkiel leads the practice and is well versed in new technologies and the intersection of these technologies with the competition and consumer protection laws. Co-head Dorothy Hansberry-Biegunska has experience defending clients in cartel matters, including building Article101(3) TFEU defences.

Represented Mastercard in a civil damage action case brought by a plaintiff in Poland concerning interchange fees and an alleged violation of the EU and Polish competition laws.
Representing Verdano Investment, its president of the board, and another company of the president before the Competition Court and the Appellate Court in an appeal of the Competition Authority’s decision finding that the charged parties, had violated the competition laws by reaching a horizontal agreement in which they allegedly divided the fitness market in Poland in violation of both Polish (article 6) and EU competition laws (article 101.1 TFEU).
