Instructed by a client to recover £1.3 million owed to them by a high street retailer for display items manufactured and supplied to them when opening and refurbishing their stores following a response from the debtor’s in-house team contending there was a disputed balance which they failed to pay. A 3-day winding up letter was issued, and after negotiations, a payment of £1.2million was made.
Instructed by Alpha to apply for an injunction restraining Signal from advertising a winding up petition against Alpha. The alleged debt of £1.2M which was the subject of the petition flowed from a failed financing deal. The client asserted a complex cross claim based on fraudulent misrepresentation in order to obtain the injunctive relief sought, and was successful in its application in the insolvency court.
