Jointly led by Rachel Turner and Floyd Porter, the ‘reliable and efficient’ team at Miles & Partners LLP helps clients who are unable to make fundamental health and welfare decisions themselves. The firm is regularly instructed by the Official Solicitor, Relevant Person’s Representatives, and relatives to work on s.21A of the MCA 2005 cases. The department is experienced in challenging detentions in hospital under the Mental Health Act, particularly in relation to forensic mental health detentions. The group is skilled at challenging unlawful detentions too, which includes bringing High Court actions for judicial reviews. It remains busy advising on other matters, such as challenges to deprivation of liberty, and sometimes on serious medical treatment cases.
