About
Varghese specialises in handling matters related to the Insolvency & Bankruptcy Code and debt recovery proceedings. He routinely appears for Indian and foreign banks.
With an extensive experience in commercial dispute resolution, Varghese has advised several clients in arbitrations and court cases related to shareholder disputes, commercial contracts, concession agreements supply, sale contracts and engineering contracts.
Varghese also extensively advised on private trusts and estate planning matters and advises several promoters in this regard.
He regularly advises clients on Indian law issues concerning General Corporate laws, Exchange Control regulations, and Securities Regulations.
Experience
With an extensive experience in commercial dispute resolution, Varghese has advised several clients in arbitrations and court cases related to credit and financing agreement, shareholder disputes, commercial contracts, as well as matters relating to white collar criminal proceedings.
Varghese also extensively advised on private trusts and estate planning matters and advises several promoters in this regard.
Some of his recent assignments include:
• Representing Mashreq Bank, UAE and Hengyang Valin Steel Tube Co, China in trade dispute before the Hon’ble Bombay High Court in relation to a supply of steel product;
• Currently advising Standard Chartered Bank, Deutsche Bank, State Bank of India and DBS Bank on various recovery proceedings as well as before enforcement agencies;
• Representing Maersk Trade Finance Services in proceedings before the NCLT, NCLAT & Hon’ble Supreme Court of India on recovery of dues against various trading companies;
• Representing Bharat Petroleum Corporation Limited (BPCL) in insolvency proceedings relation to Videocon Industries Limited;
• Represented Aircel Limited in its corporate insolvency proceedings;
• Represented Adani Wilmar in the corporate insolvency proceedings of Ruchi Soya Limited;
• Representing Deutsche Bank in the corporate insolvency proceedings of United Seamless Tubular Private Limited;
• Representing Trafigura Group in proceedings before the NCLT & Hon’ble Bombay High Court in recovery of dues from Nicomet Industries Limited;
• Multiple arbitration proceedings for the Sulzer Group, Switzerland for recovery of dues. Also representing the Sulzer Group in various proceedings against revenue agencies.
Varghese has been with JSA since 2003 and was promoted as a Partner of the firm in 2007. He has been practising law since 2000.
