The IRS has issued guidance (Notice 2012-74) providing the due dates for the various forms and procedures for the 2013 pharmaceutical industry fee year. Form 8947, Report of Branded Prescription Drug Information, is due by Dec. 17, 2012.

The annual industrywide fee on drug manufacturers and importers was enacted as part of the 2010 health care reform legislation, and was imposed for the first time in 2011. The fee is allocated annually among manufacturers and importers of branded prescription drugs based on the proportion of each entity's sales to government health care programs. The guidance for implementing the pharmaceutical industry fee was issued as temporary regulations in 2011 (T.D. 9544), but Notice 2012-74 provides the following due dates and guidance for the 2013 fee year:
