Key Points

  • The Biden administration's highly anticipated executive order (EO) on artificial intelligence (AI) contains a wide range of directives for addressing risks associated with the development and deployment of AI, many of which are entwined with data privacy and cybersecurity.
  • The EO directs agencies to develop and strengthen techniques to preserve individuals' privacy and identify personal information collected from commercially available sources like data brokers. The EO also orders agencies to increase use of privacy-enhancing technologies (PETs) such as encryption tools.
  • The EO aims to build new standards and guidelines for AI cybersecurity, focusing on critical infrastructure owners and operators. In a bid to prevent use of U.S. infrastructure as a service (IaaS) product by foreign cyber attackers, the EO also requires the Secretary of Commerce to set reporting requirements for IaaS providers to verify identities of foreign buyers.
