UAE Opens Class 33 For Alcoholic Beverage Trade Marks

The UAE Ministry of Economy and Tourism has begun accepting trade mark applications in Class 33 for alcoholic beverages, marking a significant shift in the country's intellectual property framework. This development raises important questions for beverage brand owners about portfolio strategy, the status of existing Class 32 registrations, and how earlier rights will interact with new Class 33 applications.

The UAE Ministry of Economy and Tourism and Trade Mark Office are now accepting trade mark applications in Class 33 for alcoholic beverages, with immediate effect.

Until now, Class 33 was not available for trade mark registration in the UAE, in line with local policy and regulations. As a result, owners of wines, spirits and other alcoholic beverage brands often relied on Class 32 as part of their UAE protection strategy.

This change reflects the UAE’s evolving IP framework and its increasingly international economy. It also gives beverage brand owners a timely reason to review how their brands are protected in the UAE.

An evolving trade mark framework

This is a change in Trade Mark Office practice and does not require an amendment to the UAE Trade Mark Law.
