19.09.2023 tarihinde Karayolları Motorlu Araçlar Zorunlu Mali Sorumluluk Sigortasında Tarife Uygulama Esasları Hakkında Yönetmelik'te yapılan bir değişiklikle, makul seviyeden daha fazla risk arz eden taşıtların zorunlu mali sorumluluk sigortaları zarar anında mevcut olmasa bile, üçüncü kişilerin zararları, belli şartlar altında, Riskli Sigortalar Havuzuna üye sigorta şirketleri tarafından paylaşılmaktadır.

Giriş

Motorlu taşıtlar için sorumluluk sigortası ("ZTS"), Karayolları Trafik Kanunu (no. 2918) ile yapılması zorunlu bir sigortadır. Bu zorunluluk araç işletenler kadar, sigorta şirketlerini de ilgilendirmektedir. Sigortacılık Kanunu (no. 5684) sigortacıların kendilerine bu gibi zorunlu sigorta talebiyle başvuran kişilere sigorta teminatı vermekten kaçınamayacağını düzenlemektedir.
