Aleyhe bozma yasagi (reformatio in peius) ¹, kanun yoluna sanik lehine basvurulmasi neticesinde yeniden verilen kararin önceki karardan daha agir olmamasidir. Aleyhe bozma yasagi saniga, haksiz oldugunu düsündügü bir hükme karsi kendisine taninan hukuki yollari kullanmasi sebebiyle daha agir bir cezayla karsilasmasi riskini ortadan kaldirmayi amaçlamaktadir. Bu nedenle aleyhe bozma yasaginin özellikle Alman Imparatorluk Mahkemesi'nce (Reichtsgericht) " usul
