The IBA Adopts New Rules On Evidence In International Arbitration

SwitzerlandLitigation, Mediation & Arbitration

Committee D (Arbitration and ADR) of the International Bar Association (IBA) has adopted under Chairman David W. Rivkin a new version of its Rules on the Taking of Evidence in International Commercial Arbitration on 1 June 1999. The previous version dates back to 1983. The Rules have now been printed in a convenient booklet form. The Rules can also be acquired in PDF format from the IBA's web site, www.ibanet.org.

The Rules apply when the parties have agreed, or the arbitral tribunal has decided, to apply them. The Rules deal in particular with production of documents, witnesses (but not depositions), site inspection, evidentiary hearing, as well as the admissibility and assessment of evidence.
