Como parte de la reforma constitucional del 2017 a los artículos 17 y 73 fracción XXIX-A, se concedió al Congreso de la Unión la facultad para expedir la ley general que estableciera los principios y bases en materia de mecanismos alternativos de solución de controversias, con excepción de la materia penal; misma que según los artículos transitorios de dicha reforma debió haberse promulgado dentro de un plazo de 180 días siguientes a la entrada en vigor del citado decreto.

No fue hasta el pasado 26 de enero que se publicó en el Diario Oficial de la Federación el Decreto por el que se expide la Ley General de Mecanismos Alternativos de Solución de Controversias ("Ley MASC") y se reforma y adiciona la Ley Orgánica del Poder Judicial de la Federación y la Ley Orgánica del Tribunal Federal de Justicia Administrativa.
