Процесс экстрадиции обеспечивает передачу лиц, обвиняемых или осужденных за преступления, из одной юрисдикции в другую для привлечения к уголовной ответственностью или исполнения приговора, а также проведения следственных действий. Выдача допустима только при выполнении всех установленных законом процедур (ст. 579–595 УПК РК).

Выдача лиц, обвиняемых или осужденных за преступления, регулируется как национальным законодательством Казахстана, так и международными договорами. Основными документами являются Конвенции "О правовой помощи и правовых отношениях по гражданским, семейным и уголовным делам" (Минск, 1993; Кишинев, 2002), а также Конвенция ООН против транснациональной организованной преступности (Палермо, 2000).
