The Royal Court of Jersey has clarified the legal framework for obtaining freezing orders to prevent asset dissipation before and after judgment. While the legal test remains consistent across both stages, the evidential burden differs significantly, with post-judgment applications requiring lighter evidence when liability has been crystallised through a judgment or arbitration award.

key takeaways

  • A Jersey freezing order prevents assets being dealt with in a way that could frustrate enforcement of a future or existing judgment or arbitration award.

  • A plaintiff must generally show a serious issue to be tried, a real risk of unjustified dissipation, and that granting relief is just and convenient.

  • The legal test is generally the same before and after judgment or an arbitration award but the evidence required is in practice lighter after judgment or award.

  • The Royal Court is willing to assist judgment creditors enforcing valid judgments and arbitration awards against Jersey assets.

  • Prolonged non-payment, unexplained conduct and attempts to frustrate enforcement may support a finding of dissipation risk.
