While the EU, UK, India, China, the US and, to some extent,
Brazil remain key battlegrounds for enforcing standard essential
patents, SEP holders are increasingly incentivised to explore new
jurisdictions to strengthen their positions in global licensing
negotiations.
When selecting additional countries for enforcement, market size
and the predictability of the Legal system are primary
considerations. Southeast Asian countries, with their large markets
and improving legal frameworks, are emerging as attractive
destinations for SEP enforcement.
Southeast Asia represents one of the fastest-growing markets
globally, with a combined population exceeding 670 million. For SEP
holders, the key SE Asia markets of Indonesia, Philippines,
Vietnam, and Thailand are not only important jurisdictions for
patent enforcement but also critical leverage points in global
FRAND rate negotiations.
