Le 12 janvier 2021 a été publié au Journal Officiel l'« Avis relatif aux recommandations de l'Agence française anticorruption destinées à aider les personnes morales de droit public et de droit privé à prévenir et à détecter les faits de corruption, de trafic d'influence, de concussion, de prise illégale d'intérêts, de détournement de fonds publics et de favoritisme » 1.

Ces nouvelles recommandations définissant les modalités de mise en Suvre d'un dispositif anticorruption entrent en vigueur le 13 janvier 2021. Elles annulent et remplacent les recommandations du 22 décembre 2017. En outre, « l'AFA se réfère aux recommandations dans le cadre de ses missions de conseil et de contrôle. Elle ne se référera aux présentes que pour les contrôles ouverts à compter du sixième mois suivant celui de leur entrée en vigueur ».
