Bestrebungen zur Schaffung eines einheitlichen Europäischen Schutzrechts, das alle nationalen Patente ersetzen könnte, hat es in Europa schon seit den Siebzigerjahren gegeben. 2009 unternahm die Europäische Kommission mit dem sogenannten Unitary Patent Package", einer Kombination aus der Verordnung über das Einheitspatent und dem Übereinkommen über das einheitliche Patentgericht (UPC), einen weiteren Anlauf, den Spanien und Italien (erfolglos) vor dem EuGH bekämpften. Anschließend brachten der Brexit" und die darauf folgenden Neuwahlen im Vereinigten Königreich neue Unsicherheiten.
