Par notre récente chronique intitulée « L'injonction pour ordonner le sursis d'une prise de décision en matière d'adjudication de contrat », nous vous informions de la décision rendue le 21 mars dernier par laquelle la Cour supérieure a accueilli les demandes d'injonctions provisoires présentées par Construction Bau-Val (« Bau-Val ») et Demix Construction (« Demix ») et ordonné à la Ville de Montréal de surseoir à sa prise de décision de l'attribution de contrats.

Subséquemment, le 15 avril dernier, les parties ont été entendues au mérite par l'honorable juge Anne Jacob. Le 20 mai dernier, la Cour supérieure a accueilli les demandes en injonctions permanentes présentées par Bau-Val et Demix et a interdit que les contrats de constructions liés à des appels d'offres soient attribués à des entreprises autres que Bau-Val et Demix (Groupe CRH Canada Inc. (Demix Construction) c. Ville de Montréal ).
