LATAM countries your role covers: Brasil, Argentina, Chile, Mexico. Previously I also took care of Central America and Colombia.

What are the most significant cases and transactions in the LATAM region that you or your legal team have recently been involved in?

Acquisitions of other companies. Establish a litigation strategy for employment lawsuits. Negotiate Global Strategic Accounts in several jurisdictions in Latin America. Compliance day trainings for the business.

What are your organisations plans in the LATAM region over the next 12 months and how will your legal expertise help to achieve these plans?

Since December 2022 I have moved to Europe (Barcelona) and I am entitled for Iberia (Portugal and Spain) in a different platform of companies (Healthcare) part of the Danaher Group. For this new platform is important to understand the changes in the Legal world.

In general terms I would say that to help to achieve the plans the Legal Team are investing time in legal trainings for new trends, knowledge, and improvements. At Danaher we have a tool called Danaher Business System training, which among other things help you to solve problems and it is also a Flow of Continuous Improvement Learning Path. Other legal trainings for development of capability of Legal Digital Training, such as software contracts and terms, regulatory and trade compliance overview, artificial loud tech, data analytics, artificial intelligence, machine learning, remote access.

It is also important to participate in human resources initiatives such as awareness on equal opportunities- gender, compliance with the implementation of tools to control the approvals and comply with laws and privacy (GDPR) trainings.

How do you adapt your legal counselling to align with the diverse business practices and customs of various LATAM countries?

A combination of technology and soft skills. The use of Contract Management tools with a repository of legal clauses adapted to different jurisdictions, a playbook to help you out on how to negotiate the most critical matters, a set of templates to be used in different countries with adaptation to local laws.

There are also good litigation tools to control the status of lawsuits, strategy, and budget control. I understand it is paramount to have the right tools to harmonise the approach in different jurisdictions. However, it is equally important to understand the difference between cultures and your business partners. Have a law firm with presence in most of the LATAM countries that understand your business is also a very useful.
