What are the most significant cases or transactions that your legal team has recently been involved in?

The legal area has been working with special dedication in resolving claims in class action cases, initiated by non-profit consumer protection organisations, considering the importance of the amounts claimed and the reputational risk associated with these kinds of lawsuits.

Additionally, other relevant issues in which the legal area has participated include: the re-launch of the Procrear public programme where Banco Hipotecario is the administrative agent, the participation in a digital wallet created by many banks in Argentina, defining legal strategies in relation to cyber fraud to our clients, and negotiating the refinancing of debts of important corporate clients.

In a changing financial landscape, how does the company remain competitive against new phenomena such as fintech and blockchain, and how does the legal team assist with this?

The Fintech ecosystem has grown enormously in Argentina, especially since the beginning of the pandemic. Most banks, private and public, have had to redefine their business strategies and implement improvements in their customer service channels.

In the bank where I work, retail banking has been modernised through its digital channels, allowing banking and financial services to be more accessible to sectors of the population, for which it was not possible to access previously, including young people who they are not interested in traditional banks.

The legal area is constantly assisting the business in the design of digital onboarding processes, identifying risks and opportunities for improvement.

In what ways do you see the in-house legal role evolving in your region over the next few years?

I believe that the role of in-house lawyers, especially in consumer business companies, must be more proactive, not being focused solely on solving the disputes generated by legal relationships created by new technologies and customs, but also in participating with a more active role in the design of new products and services.

In addition, I believe that it is essential that in-house lawyers be trained not only in specific legal matters, but also in technological developments issues, at least to be able to understand how they work.
