Joost Elsenburg is a partner in the Banking and Finance Team based in Amsterdam, focusing on financial regulation, including MiCAR. With over 20 years of experience, working on all sides of the financial regulatory landscape, Joost has cultivated a deep understanding of the complexities involved in this field.
Beginning his career in 2005 at the Dutch financial regulator (AFM), where he gained invaluable insights into regulatory frameworks drafting and interpreting legislative proposals, Joost went on to garner substantial experience in the banking sector, spending five years at prominent institutions (ABN AMRO and ING). There, he represented the bank’s interests on provisions of cross-border services, compliance (remediation) projects, implementing new (EU) legislation (e.g. benchmark regulation, EMIR, MAR, MiFID II projects), (re)drafting of policy and governance documents.
Joost honed his legal skills working as a lawyer for 11 years at leading law firms (including HVG Law and A&O Shearman, where he was Counsel and Co-Head of the Financial Regulatory Practice). He has advised on many multi-jurisdictional projects, (M&A, surveys and cross border service models), provided high-end advice on specific topics (Brexit, Remuneration and AML/KYC) and assisted in questions regarding listed entities or shareholders (disclosure requirements, market abuse issues and notification requirements).
Given his unique blend of regulatory, banking and legal experience Joost can offer clients a comprehensive perspective on the diverse viewpoints of various stakeholders. Known for being “responsive; pragmatic when it comes to providing business-orientated solutions” (Legal 500), he has supported clients on a wide range of financial regulatory matters, including cross-border projects involving M&A and restructuring, along with the associated regulatory requirements. He assists financial institutions with license applications and establishing robust control and policy frameworks. He frequently advises clients on cross-border strategies and remediation projects related to legal and compliance issues. Additionally, Joost provides guidance to international organizations on the nuances of Dutch financial legislation, potential exemptions and the implementation of new EU regulations.
