Career

The former Solicitor General of West Virginia, Elbert Lin co-chairs the Issues and Appeals practice at Hunton. He has argued more than seventy appeals across the country, including in the U.S. Supreme Court and before several en banc appeals courts.

With experience in the private sector and multiple branches of government, Elbert’s practice has spanned a wide range of issues, including major questions of constitutional and administrative law at the federal and state levels. During more than four years on the West Virginia Attorney General’s senior staff, Elbert oversaw all civil and criminal appeals, managed all legal issues involving the federal government, and supervised nearly fifty Attorney General opinions. For two years as a trial attorney with the U.S. Department of Justice, Elbert primarily litigated suits involving the constitutionality of federal laws and challenges to federal agency action. He has also clerked for U.S. Supreme Court Justice Clarence Thomas, U.S. Court of Appeals Judge William H. Pryor Jr., and Senior U.S. District Judge Robert E. Keeton.

Elbert is an elected member of the American Law Institute, a fellow of the American Academy of Appellate Lawyers, and a senior fellow of the Administrative Conference of the United States.
