Industry focus: Manufacturing Tier 1

The cross-departmental team at White & Case LLP leverages the firm’s contentious, corporate, competition and regulatory expertise to serve its manufacturing clients. The group is instructed by Toshiba in follow-on damages actions relating to its joint and several liability with its joint venture for involvement in the cathode ray tubes cartel. A team led by James Killick advised Eurofer on several matters, including handling anti-dumping proceedings, as well as assisting with the European Commission’s global safeguards investigation concerning imports. The department also counts Sanitec, Nexans and Celsa Group among its clients. Jacquelyn MacLennan and counsel Richard King are highlighted for competition law and international trade matters respectively.

Insolvency and restructuring Tier 1

White & Case LLP's 'attentive' insolvency and restructuring team is experienced in handling domestic and cross-border matters and acts for clients including GSO, Goldman Sachs and Deutsche Bank. The department is advising Standard Chartered Group, as lender to Exelco, on the latter's insolvency filings in the US and Belgium. In another prominent matter, practice head Thierry Bosly led a team that assisted Ecobank on a global restructuring and recovery of debt facilities granted to the construction group Zakhem to build pipelines in Kenya. Other key names to note include Muriel Alhadeff and Nathalie Colin for insolvency advice and contentious matters respectively.

Banking, finance and capital markets Tier 2

White & Case LLP features prominently in novel and landmark banking and capital markets transactions, where it acts for corporates, private equity sponsors and financial institutions. One of its areas of strength is in acquisition and leveraged finance deals; in a recent highlight, Hadrien Servais worked with the London office to advise JP Morgan, ABN Amro, BNP Paribas Fortis and Rabobank on the provision of over €2bn leveraged financing to Refresco in relation to its acquisition of Cott's North American bottling activities. Another highlight saw Servais and others act for ABN Amro Bank, Barclays, ING Bank, Sumitomo Mitsui Banking Corporation and Unicredit on the financing to EQT of its acquisition of pan-European dental business Curaeos. Servais was also part of the cross-office team, which assisted Credit Suisse and Barclays with the €670m financing of Lone Star's acquisition of minerals company Imerys. Another key figure is Thierry Bosly, who has more than 25 years of experience in advising borrowers and lenders on matters connected with receivables finance, public offerings of bonds, securitisations and project finance, among other areas. Servais and Bosly co-head the practice with counsel Willem Van de Wiele, whose banking transactional work is complemented by his expertise in banking and financial services regulation. In addition, Van de Wiele also handles debt and equity capital markets transactions, and is also particularly noted for his knowledge of fintech and blockchain technology.

Competition: EU and global Tier 2

White & Case LLP has 'an outstanding team for all antitrust matters'; it 'can be real fighters when the case warrants it'. In addition, it 'can count on an extensive and strong worldwide network'. Led by Mark Powell, the group is particularly well-known for its work in high-stakes (and often landmark) antitrust litigation, conduct investigations and cross-border M&A (involving particularly challenging clearance issues). One of the team's areas of sector expertise is in the telecoms industry, where Powell, Alexandra Rogers and others are acting for Deutsche Telekom in a proposed 'four-to-three' merger in the Dutch mobile telecoms sector between Tele2 Netherlands and Deutsche Telekom’s subsidiary T-Mobile Netherlands, which is currently the subject of an EC phase two investigation. On the behavioural side, the firm has a particularly standout reputation in the pharmaceutical sector where it handles matters that are of critical significance to the industry. The firm has been on the front line in cases involving patent settlement agreements; James Killick ('a leading expert on all aspects of EU competition law within the life sciences sector, including pricing matters, parallel trade, retail and wholesale strategy') and Jérémie Jourdan are representing Servier at the General Court in an appeal of the EC's decision to impose a €331m fine on the client for entering into pay-for-delay agreements with generic drugs manufacturers in order to delay the market entry of generic versions of cardiovascular drug Perindropil. In another matter, Killick and Assimakis Komninos acted as co-counsel to Pfizer in its appeal of the CMA's decision on excessive pricing before the Competition Appeal Tribunal. In the financial services arena, Powell and Jourdan are part of a cross-office team which is advising Crédit Agricole on multiple worldwide investigations into the setting of Euribor and Libor indexes. The firm also has a strong reputation in matters involving the energy and technology sectors. Elsewhere, 'the firm's combination of state aid expertise and sectoral knowledge sets it apart from a number of other law firms active in the area'. Powell's team also includes Jacquelyn MacLennanKai Struckmann and Strati Sakellariou-WittGenevra Forwood and Katarzyna Czapracka recently made partner.

Customs, trade, WTO and anti-dumping Tier 2

The team at White & Case LLP has been kept busy with a workload dominated by anti-dumping matters, notably for clients from the steel industry; for example, practice head James Killick is representing Salzgitter, alongside a number of affiliated steel mills and resellers, in the US anti-dumping investigation into imports of cut-to-length plate from Germany, and is acting for longstanding client Eurofer and a number of European producers in a global safeguards investigation initiated by the trade authorities in Turkey. Jacquelyn MacLennan is the key contact for customs matters and counsel Richard King is also noted.

Dispute resolution Tier 2

White & Case LLP's department head Nathalie Colin is leading a team representing a Swedish private investor and three prominent Romanian companies in ongoing litigation relating to the enforcement of a €200m arbitral award against Romania by ICSID. Bank Indonesia and Facebook are also key clients. Thierry Bosly is a name to note for contentious insolvency cases.

EU regulatory: Pharma, medical devices and biotech Tier 2

The group at White & Case LLP is strong in handling competition matters, patent issues and parallel trade mandates. Recent work includes assisting Pfizer with its appeal before the Competition Appeal Tribunal against the CMA's decision concerning alleged excessive pricing.
