Career
Michael Yuffee focuses his practice on regulatory, enforcement defense, compliance, and transactional matters relating to the energy and commodities markets. Michael has extensive experience representing clients in energy and commodity-related regulatory proceedings and investigation matters before the Federal Energy Regulatory Commission (FERC) and the Commodity Futures Trading Commission (CFTC). Michael handles matters arising under the Federal Power Act, the Public Utility Holding Company Act of 2005, the Energy Policy Act of 2005, the Public Utility Regulatory Policies Act of 1978, the Natural Gas Act, the Natural Gas Policy Act of 1978, the Commodity Exchange Act, and various other federal and state laws.
He regularly represents power producers, energy traders and marketers, commodities traders, financial institutions, wholesale power suppliers, and integrated energy companies with the development of regulatory compliance programs as well as represents clients in both public and non-public investigations and enforcement actions. He is likewise experienced in the regulatory facets of both the physical and financial wholesale power markets, including the formation and redesign of wholesale energy markets, transmission rate proceedings, capacity market development, interconnection issues and general administrative and civil litigation matters. Michael also advises clients with regard to the regulatory implications of structured physical and financial energy transactions, project development transactions, and wholesale power and natural gas transactions.
Michael has over 30 years of experience in the energy industry and in practicing energy regulatory law. Michael began his career working for the federal government, first at the U.S. Department of Energy, and then as an attorney-advisor in FERC’s Office of Administrative Law Judges.
