The ‘great commercial litigators’ at Baker Botts L.L.P. are active across a number of sectors, notably energy, defending corporate clients and their directors and officers facing merger-related suits in Delaware, Texas and the federal courts, in addition to offering assistance in related securities and derivative disputes. In Houston, managing partner Danny David and Amy Hefley lead on high-value disputes for clients and in 2024 defended Camber Energy, Inc. in a suit arising out of its 2023 merger with Viking Energy Group, with a former shareholder of the latter accusing Camber’s CEO of breach of fiduciary duties. Securities litigation and white collar matters form the core of head of the litigation team Bridget Moore‘s Washington DC-based practice. Richard Harper, who heads the firm’s New York office, is sought after by TMT sector clients facing M&A suits, including assisting Liberty Media in settling a shareholder derivative action related to the buyback of $2bn-worth of SiriusXM shares, of which Liberty is the controlling shareholder, alleging that Liberty directors had breached their fiduciary duties and effected a short term merger.

Testimonials

‘The appellate team I have worked with is exceptional. They are very quick, have a broad base of specialization, and are very much a bet-the-company type of go to team, especially in the Fifth Circuit and, as may be necessary, in the US Supreme Court. Best trait of this team is they are not very ego driven and this leads to extensive willingness to collaborate with client, trial team and even co-appellate counsel to maximize chances of success. Very strategic-minded.’

‘Aaron Streett is probably the smartest, and most effective appellate advocate I have ever worked with. His ability to shine as he does is, as he will admit, a function of the team he surrounds himself with, in our case, Christopher Tutunjian. These fine lawyers really immerse themselves in their cases and in the record, and use their deep dive into the record more effectively than anyone I have encountered.’

‘The depth of talent is second to none at all levels, from the senior partners within the practice group, to the young associates. The firm has assembled an impressive team across all levels of experience.’

‘Aaron Streett possesses Solomonic wisdom and judgment coupled with a quiet confidence and humility that make him an authoritative, trustworthy, convincing and credible advocate.’

‘Anthony Lucisano is a gifted writer that wins on his papers, and a rising star who is equally capable in translating written work product into compelling, authoritative oral advocacy.’

‘The depth of talent is second to none at all levels from the senior partners within the practice group, to the young associates that are taking the labouring oar on legal research and the drafting of briefs’.

‘The firm has assembled an impressive team across all levels of experience.’

Latin America: International firms > International arbitration Tier 3

Baker Botts L.L.P. cemented its position in the international arbitration field by hiring Jennifer Haworth McCandless and special counsel María Carolina Durán, 'two of the best lawyers in the field', along with a broader Washington DC-based team from Sidley Austin LLP in 2023. Featuring a number of native and fluent Spanish speakers, the new group brings further credibility - particularly as regards investor-state arbitration; current mandates include the ongoing representation of the Republic of Peru in a series of ICSID and other arbitrations; the team has also acted for a number of other Latin American states. Beyond sovereign governments, the firm represents a range of investors and Latin American corporates. The practice continues to be recognised for energy and infrastructure disputes, with further growth in technology, mining, ESG and energy transition cases. The wider Latin America-focused department is largely spread across  the firm's Washington DC, New York and London offices, the latter housing key partner Alejandro Escobar ('an outstanding lawyer who works to the highest standards') is located. London senior associate Ernesto Féliz De Jesús ('critical thinking and assertiveness in understanding aspects of technical complexity') specialises in Latin America cases, including public international law matters, and commercial and construction arbitration.

Testimonials

‘It is an extremely solid team, with the ability to put together complex legal strategies in a short time. It seems to me to be a first-class team for international arbitration issues.’

‘Jennifer Haworth and María Carolina Durán are exceptional. Their work is fantastic in international arbitration, they are devoted to the client, always available and ready to provide sound advice.’

‘I had the opportunity to work with the Baker Botts international arbitration team. Mainly with Alejandro Escobar and Ernesto Feliz de Jesús. It is an excellent team, much more prepared and dedicated than many other international offices. The partners have a direct participation in the details of the conflict.’

‘Alejandro Escobar has had a remarkable career that is recognised in high-level forums. Without a doubt, his professional capacity is an appreciable aspect when considering participation in a specific case. However, there are other aspects that have equal weight such as transparency, probity and ethics with which matters are handled with the advised entities. Ernesto Féliz de Jesús shares Alejandro’s vision and objectives. One of Ernesto’s most striking qualities is his critical thinking and assertiveness in understanding aspects of technical complexity and his ease in presenting them to a highly specialised forum.’

‘ I worked in international arbitration with BB, a team made up of a small number of people who worked with great dedication and meticulousness, achieving favourable results. They proved to be detail-oriented and highly organised in their work. Since it was not a large team, costs were reduced and knowledge of the case was shared by all of them.’

‘Alejandro Escobar has excellent critical thinking. He excels at opening statements and cross-examination, displaying meticulousness in his approach. His personal warmth makes him very easy to work with. Ernesto Feliz is also very organised. Both are impeccable, clear and precise.’

‘Alejandro Escobar is an outstanding lawyer who works to the highest standards. He has an unparalleled legal education, is a world-renowned practitioner, and also has great analytical depth, and is charming.’

‘Jennifer Haworth and María Carolina Duran are two of the best lawyers in the field.’

Latin America: International firms > Projects and energy

Baker Botts L.L.P. has a strong foothold in the LNG and renewables market in Latin America. This includes M&A transactions, project development and project finance engagements. It is gaining further ground in energy transition matters, especially green hydrogen projects in the region; recent mandates include adviseing HIF Global on its development of a green hydrogen to e-fuels project in Chile. The firm has extensive experience in project development and structuring, and has represented clients in projects across the region - most notably in Mexico. It has primarily focused on representing sponsors and developers, although the March-2024 hire of Veronica Relea (from Pillsbury Winthrop Shaw Pittman, LLP), brings the firm additional credibility in New York and further connections to sponsors and lenders; her arrival follows that of Mona Dajani to the New York office from A&O Shearman the previous year. The firm’s heartland remains Houston where Carlos Solé is a prominent figure in LNG and renewables matters, especially in Mexico. Houston-based David Jetter is another LNG expert and is increasingly prominent in energy transition matters. San Francisco’s Dino Barajas has led power and renewables projects across Latin America for decades and is also noted for his experience in Mexico.
